style='line-height:1.75em;'>在标准工时制下，加班包含三种情形：延时加班、休息日加班和法定休假日加班。</p><p><br></p><p style='line-height:1.75em;'>根据最新发布的《全国年节及纪念日放假办法》（2024年修订）规定，全年法定节假日共13天：</p><p><br></p><p style='line-height:1.75em;'>（一）元旦，放假1天（1月1日）；</p><p><br></p><p style='line-height:1.75em;'>（二）春节，放假4天（农历除夕、正月初一至初三）；</p><p><br></p><p style='line-height:1.75em;'>（三）清明节，放假1天（农历清明当日）；</p><p><br></p><p style='line-height:1.75em;'>（四）劳动节，放假2天（5月1日、2日）；</p><p><br></p><p style='line-height:1.75em;'>（五）端午节，放假1天（农历端午当日）；</p><p><br></p><p style='line-height:1.75em;'>（六）中秋节，放假1天（农历中秋当日）；</p><p><br></p><p style='line-height:1.75em;'>（七）国庆节，放假3天（10月1日至3日）。</p><p><br></p><p style='line-height:1.75em;'>因此，上述13天为法定节假日，如果劳动者加班，用人单位应支付三倍工资。其他的周末休息日及调休的休息日加班，用人单位就需支付两倍工资。</p><p><br></p><p style='line-height:1.75em;'>举个例子，2025年春节假期从除夕至初七共有8天，但是只有除夕至初三这4天是法定节假日，可以主张三倍工资；其余4天均为调休，用人单位不予调休时可以主张两倍工资。</p><p><br></p><section data-role="title" data-tools="135编辑器" data-id="145649"><section style='line-height:1.75em;'>按照《中华人民共和国劳动法》第五十一条，劳动者在法定休假日和婚丧假期间以及依法参加社会活动期间，用人单位应当依法支付工资。故折算日工资时需要剔除周末休息日，但不需要剔除法定13天节假日。因此，按照每年有365天、52个周来计算的话：</p><p><br></p><p style='line-height:1.75em;'><span
