font-size: 12px; color: rgb(191, 180, 161);'> </section></section></section></section></section></section>该小区新房均价4万元/㎡左右，于今年4月开始分批交付。<o:p style='outline: 0px;'></o:p> 不过早在2021年底，业主们就已经成立了小区业主群，业主必须出示能证明身份的信息，由群主审核后才能进群。<o:p style='outline: 0px;'></o:p> 图源视觉中国 2022年10月25日，严某被群主余某邀请进群，随后将群名修改为其“房源号”。由于有群主把关，也没有该房源号对应的业主跳出来指责，所有业主理所当然地认为此人也是他们的邻居之一，完全没想到这是位假业主。<o:p style='outline: 0px;'></o:p> 今年2月22日，严某在业主群里表示，房子交付在即，自己受广大业主委托，将帮小区进行招商，邀请外来商家来群内做广告，按照单品类商家1000元、全案装修公司2000元的标准向这些商家收取“进场费”，这些款项归全体业主所有，由群主代收代管。<o:p style='outline: 0px;'></o:p> 此时正值小区交付前期，业主们确有装修需求，再加上严某表示，除了广告费外，商家还会在业主扫码进入的团购群内发放红包，所以业主们并未提出质疑，只当是有个热心的业主帮着小区张罗装修事宜，还能为小区增加收入。 从4月到7月，陆续有60多家装修公司、家具公司到业主群内做广告，共向全体业主支付广告费7.7万元，均由群主余某代为保管，并公布金额明细。<o:p style='outline: 0px;'></o:p> 然而，当一商家向其中一位业主介绍产品时，抱怨他们小区的广告费太高，要五六千元，再加上团购群里还要发两千元的红包，结果一桩生意都还没谈成，这广告费花得实在不划算。一两千元的“进场费”怎么到了商家这变成了五六千元，业主们发现自己上当了。<o:p style='outline: 0px;'></o:p> 随即，业主们纷纷向来群里做过广告、有过联系的商家们打听情况，不问不知道，原来严某对内声称一两千元的广告费，对外却向商家收取3000、5000、6000元不等的广告费用，个别商家甚至支付了8000元的“进场费”。<o:p style='outline: 0px;'></o:p> 而这些差价，自然是进了严某的口袋。“据我们和商家沟通之后了解到的信息，保守估计，短短4个月，他凭借这种方式最起码赚取了15万元。”一位业主表示，这些钱原本应该属于全体业主共有的经营性收入。 <section data-role="outer" label="edit by 135editor" style='outline: 0px; font-size: 12px; color: rgb(191, 180, 161);'> </section></section></section></section></section></section> 业主们坐不住了，认为这位“邻居”赚了昧心钱。随着进一步调查，他们惊讶地发现，严某并非该小区业主，是位假业主。<o:p style='outline: 0px;'></o:p> 一名假业主为何能在群里藏这么久？业主们认为有两个人脱不开干系，一个是认证信息的群主，另一个是该房源号的真业主。<o:p style='outline: 0px;'></o:p> 在业主们的指责下，该房源号的真业主在群内发布了一则声明，指出严某是他的妹夫，他只是委托严某帮忙新房装修的事宜，至于严某和群主余某发起的团购，这位业主表示并不知情也从未参与。 矛头指向了群主余某，迫于业主们持续质问的压力，以及公布了商家四五千元的转账记录后，余某和严某终于承认，确实对外收取的广告费不止一两千元，两人通过此形式额外收取商家合计15万余元的款项。但是余某表示，这15万元的差价，是她和严某的佣金和辛苦费，并不属于广告费，因此也不属于小区经营性收入，除了将她代管的7.7万元交由其他业主保管外，两人拒绝退还任何费用。<o:p style='outline: 0px;'></o:p> “他们显然早有预谋，群主就是监守自盗。”小区业主表示，在他们向商家取证的过程中，商户告诉他们，严某和余某要求商家将他们个人取得的款项支付到亲属等特定关系人的微信或支付宝账号，“这就是怕穿帮了之后留下证据。” 此外，还有商家爆料，这两人在所谓的“招商”过程中，还让商家请吃饭并索要各种赠品，其中一家商户被索要了价值12000元的礼品券。“就是因为他们太贪心，这些商家才把他们‘卖了’，不然我们还会被蒙在鼓里。”一位小区业主透露，除了他们小区外，据严某自己陈述，他还参与了其他好几个新交付小区的团购，“感觉他们就是钻这种新交付小区的空子，甚至都形成‘产业链’了。”<o:p style='outline: 0px;'></o:p> 据悉，业主们已经收集好证据并报案，但是警方告知，严某和余某的行为无法以诈骗立案。<o:p style='outline: 0px;'></o:p> 本周二，小区业主再次向公安机关报案，但最终调解未果，严某、余某一分钱也不愿意退还。 <section data-role="outer" label="edit by 135editor" style='outline: 0px; font-size: 12px; color: rgb(191, 180, 161);'> </section></section></section></section></section></section>泰和泰(北京)律师事务所顾问李光认为，二人的行为确实很难被定义为诈骗，“诈骗是指行为人虚构事实，让受害人陷入认识错误并交付了财物。但在这个事件中，余某和严某确实虚构了事实，但从结果上又确实打了广告费。而在陷入认识错误方面，实际上是这些商户陷入了认识错误，最后广告的效果没有达到预期。”<o:p style='outline: 0px;'></o:p> 此外，律师表示“职务侵占”也并不成立，“业务会都还没成立，职务侵占无从谈起。” 李光说，群主和假业主对于小区业主的“欺骗”，只能从道德上进行谴责。 至于余某提出这些钱并不属于小区业主的经营性收入，李光认为：“在现行的法律条款下，经营性收入是有明确规定和范围的，但广义上来说，业主群广告也应该属于小区经营性收入，原因是它就是另一种类型的广告，分发对象也是小区的业主，只不过投放的形式并不是传统的小区内物理上的公共空间，而是小区互联网环境内的公共空间。这是随着时代的变化及发展，演变出的新事物。”<o:p style='outline: 0px;'></o:p> “过去小区经营性收入还集中在道闸广告、电梯广告这些地方，但如今的小区社群，尤其是中高端楼盘的社群，比如该案例中的业主微信群，也同样具备经济价值并且也产生了经济效益。”李光表示。<o:p style='outline: 0px;'></o:p> 杭州市房管部门工作人员告诉记者：“这笔‘入场费’双方可以通过协商或者法律途径进行定性。如果定性后，是全体业主所有，可以将这笔资金作为小区共有收入，存入小区共有账户内。”</div>
